Attorney Lee Sung-woo said the ruling could be a turning point to change the practice of charging far above statutory brokerage fees under the name of real estate consulting, and the head of the Korea Association of Realtors pointed out that consulting and brokerage are entirely different and many firms have been effectively conducting brokerage under a consulting label. They expressed hope that this decision will curb unlawful excessive fees and help strengthen the rights and interests of licensed realtors.

The Daegu District Court (Kimcheon Branch) dismissed the plaintiffs’ claims, holding that a purchaser who acquires golf course property through a trust foreclosure does not bear the obligation to return existing members’ entrance deposits. The court found that trust foreclosure is not included in the transfer procedures under Article 27 of the Sports Facilities Act and that in trust sales the scope of transferred rights and obligations can be determined by private agreement. The ruling significantly affects protection of members’ deposits and may facilitate transfers for troubled golf and fitness facilities, but using trusts can create legal risks and requires expert legal advice.
