'They took me out and rented me out for 600 million'...the crazy story of how I can't get into my own home
In a case in which Mr. A was excluded from a common-share multifamily house and other shareholders received 600 million won from a third party for renting it out, Lawyer Kim Jeon-soo of Hanbyul Law Firm first ordered that the fact that he currently holds a 1/3 share should be clearly established with evidence as a key premise for judging the case. This is an essential step before filing an unjust enrichment claim or a share division lawsuit.
Mr. Kim emphasized the risks and costs of litigation, as well as the potential for relationship deterioration, and advised preparing in advance by securing evidence. Assuming that unjust enrichment and division of equity (and the risk of losing assets at auction in the event of difficulty in dividing in kind) are key legal issues, he said that litigation is a last resort that should be carefully considered.
