A civil servant in his 50s earning 5 million won a month has racked up 300 million won in debt through speculative investments... Will he lose his job if he files for personal bankruptcy?
Attorney Kim Yong-dae of Hanbyol Law LLC stated that civil servants can also file for personal rehabilitation and will not face adverse treatment at work for doing so. Personal rehabilitation is a debt adjustment system guaranteed by law, and the principle is that civil servants are not restricted from applying for it nor will their work be disrupted as a result.
Mr. A, featured in the article, is a civil servant in his 50s who has accumulated 300 million won in debt due to stock investment losses. Key factors in calculating the repayment amount include his assets—such as his family and stock holdings (worth 150 million won)—as well as the number of dependents. Debts arising from stock investments can also be eligible for personal rehabilitation if the purpose of the investment is clearly demonstrated; the court makes a comprehensive determination based on the circumstances of the investment, the amount involved, and the proportion of the total debt. However, it was also noted that there is a possibility of some impact—such as personnel transfers—for civil servants in sensitive departments related to security, human resources, auditing, and finance.
