Another juvenile in probation...teen who stood outside restroom faces jail time
Kim Jeon-soo, a lawyer at Hanbyul Law Firm, regretted that the parents delayed surrendering the cell phone at the beginning of the case, saying that if there was no evidence, it would have been better to surrender it and quickly clear their name. He emphasized that a quick response in the early stages of an investigation can make a difference in the outcome of a case.
The main legal issues in the case are not only whether the illegal filming was actually done, but also the possibility of establishing "entering a multiple-use place for sexual purposes," the difficulty of prosecuting the alleged offender, and the risk that he will soon turn 19 and be out of juvenile protection. In responding to the investigation, Mr. Kim emphasized the importance of the charges and the speedy closure of the proceedings, and recommended strategic submissions and responses in consultation with defense counsel.
However, he added that while voluntary submissions have the advantage of dismissing charges, submissions without consultation with defense counsel may expand the scope of the investigation and require a cautious approach.
