[By Kim Mi-kyung, E-Daily] Sungjoo Group's fashion goods brand MCM has shed the stigma of being the No. 1 counterfeit in South Korea.
MCM's trademark holder, Sungjoo D&D Co. announced on the 21st that it has finally won a lawsuit for damages against Ahn Mo-si, who made and sold fake handbags and wallets.
Ahn was sentenced to 10 months in prison by the Seoul Northern District Court on May 26, 2011, for manufacturing, storing and mass distributing "counterfeit" bags and wallets for sale at multiple warehouses in Gwangmyeong, Gyeonggi Province and elsewhere for several years.
MCM filed a lawsuit at the Seoul Central District Court in October 2011, represented by attorney Park Sang-hoon of Hanbyul Law Firm, to end the distribution of these fake bags and wallets.
The first trial court ruled that "the defendant's (Ms. Ahn's) products infringed the plaintiff's exclusive right to use the plaintiff's trademark, as they are highly likely to cause confusion among general consumers," and ordered the plaintiff to pay 150 million won in damages.
Ms. Ahn filed an appeal with the Seoul High Court, but the second trial ruled in favor of MCM, awarding her a total of 400 million won in damages, with an additional 250 million won. Ahn again appealed to the Supreme Court, which rejected the appeal and finalized the high court's ruling in September 2013.
"This ruling is significant in that it protects the functions of trademarks as source identification and quality assurance, raising awareness of so-called 'counterfeit' manufacturers and sellers," said MCM's legal team, adding, "We will continue to strictly enforce civil and criminal liability against trademark infringers in order to eradicate the production of counterfeit goods."
