Sex Crime Plea Agreements, 'Opinion Only' Appointments...A Poisoned Chalice?
Kim Jeon-soo, a lawyer at Hanbyul Law Firm, explained that "partial appointment" is legally possible in sex crimes cases, where the defense attorney is only asked to prepare an amicus curiae brief. He clarified that in order to submit an opinion, a lawyer must be formally appointed as a defense attorney by filing a notification of appointment with the investigative agency or court.
Mr. Kim emphasized that while partial appointment is permissible, the formal appointment process is required for the submission of an amicus curiae brief to be effective. Legal issues throughout the article include the high statutory penalties for sex offenses involving minors and the influence of the opinion on sentencing, the risk of inconsistency in defense strategy due to partial representation, and the need to weigh the cost savings against the weakening of the defense. If you are able to afford it, we recommend that you negotiate the fee arrangement and payment terms with your attorney.
