Creating deepfakes while in the military, from jail time to forced transfer
Hanbyol Law LLC Attorney Heo Eun-seok pointed out that an active-duty soldier was found to have created and distributed deepfakes targeting mostly women and tried to destroy evidence by transferring money to the hackers, and analyzed that the fact that there were multiple victims, the fact that the deepfakes were distributed, and the attempted destruction of evidence were sufficient grounds for a custodial investigation.
Meanwhile, Hanbyol Yongjun Lee, a lawyer, explained that a demand for attendance is usually sent within 1 to 4 weeks after receiving a complaint, and warned that the case can be heard in a civilian court even if the person is a member of the military, according to the revision of the Military Court Act in 2021, and that deep fakes, illegal filming, and destruction of evidence carry a high risk of severe criminal punishment, including imprisonment. If the criminal punishment is more than probation, it could lead to discharge or forced transfer, and there is also the possibility of extensive searches and swift arrests during the investigation, he added.
