While there is nothing legally wrong with a victim offering a specific settlement amount up front, Han Byul Lee, a lawyer at Law Firm (Limited), warned that disclosing the amount up front can reduce your bargaining power and risk the case being perceived as lightweight. Therefore, a safe response is to listen to the perpetrator's offer first or negotiate the amount and terms with a lawyer.

The lawyer emphasized that it is especially important to consider the seriousness of the charge of aggravated assault. Because it is a serious offense that is difficult to avoid criminal penalties by settling with the victim, he advised to strategically organize statements and evidence with legal assistance from the outset, rather than attempting to wrap up the case with a simple money transaction. Evidence, such as text messages from the perpetrator admitting to the charges, should be preserved, as it adds credibility.

Ms. Han also believes that being cautious during the negotiation process will benefit victims in the long run (although settlements in the millions of won are commonly discussed in some cases), and advises victims to consult with their lawyers before making a specific offer.
