Hacker used my account for 2 years, I don't know his address, can't sue him?
A lawyer who moved to Hanbyol Law LLC in relation to Mr. A's NAVER account theft and sales case explained that in the current state of the old-style disposition, access to case records is restricted in principle until the court finalizes the case. This is because the Personal Information Protection Act does not allow investigative agencies to provide victims with information about the perpetrator, making it difficult for them to obtain personal information.
Mr. Hanbyol advised that the most common and safest way is to wait for the court's summary judgment (summary judgment confirmation). He explained that once the summary judgment is finalized, it is possible to verify minimum personal information, such as the address of the suspect, through record inspection and search, and based on this, it is possible to send a proof of content or file a civil lawsuit. The main legal issues in the case are the return of unjust enrichment for unauthorized use of the account, damages for loss of business, and the possibility of claiming alimony for mental harm.
